  • Also, the stay at home spouse in most cases would be able to retain all of the income of the couple, thus qualifying the spouse in the nursing facility 100% for Medicaid benefits.
  • If you are the responsible party for an individual in nursing home, the guidelines will allow you protect 50% - 80% of the remaining assets and still qualify for full Medicaid benefits.

When You're Ready to Get Started

Before we can proceed, we need to gather financial data. There are several key components as far as assets and property that will affect the assessment. Before we can properly assess your situation and explain what we can or can not do for you, we will need the financial data form filled out and returned to us. The data form is confidential information between yourself and our firm.

With 99% of all spousal cases being eligible for benefits and protecting 100% of the assets and 50% - 80% of all of the assets in a single case being protected, we can assure you it is worth your time to fill out the financial data form and return to us. We can NOT help you if we do not know the full scope of the estate. Do not hesitate anymore, fill out the data form and return it today for a FREE assessment.

Once we receive the data form, we put together a free assessment that will better explain exactly what we can do for your family and how much of the estate can be protected. The assessment will address all of the legal documents you will need as well. We then explain what our fee will be in order for us to help you through this process.

Our firm charges a one-time fee that is paid from the assets of your loved one who is facing a nursing facility stay. For the fee, we become your loved ones' long term care advocate for the duration of their lifetime. Based on the amount of assets that can be legally protected from nursing facility spend down we feel that our fee will be an attractive proposition for you. We also fill out the Medicaid application (form 1200) and submit it to the State of Texas on your behalf.

Then, during the application process we track the application for you through the state Medicaid system and if necessary represent you in any appeal process should that be required at a later date. After your loved one has been on Medicaid benefits for one year, the State will send you a review form. We will fill out the review form and return it to the state for you.

All of this is included in our one time fee. Once we have explained the assessment and our fee, it is up to you. You can either move forward by hiring us or not. Remember.... the assessment is free so it costs nothing to find out what can be done.
